2:00 – 3:10 PM: Appellate Review of FERC Cost Allocation Decisions
This panel will feature a discussion of the recent FERC cost allocation decisions in the federal Courts of Appeals by the attorneys who argued those cases. The conversation will explore how the appellate courts have reviewed FERC’s identification of beneficiaries and allocation of costs to those beneficiaries and the factors that have led the courts to uphold or reject those FERC decisions.
