2:35 PM – 3:45 PM Panel 1: Transmission Rights of First Refusal: Legal and Policy Considerations
There is renewed focus on transmission ROFRs as the US Supreme Court considers addressing the constitutionality of Texas’ law restricting development of certain transmission projects to incumbent transmission owners and FERC considers whether to authorize federal ROFRs for certain transmission projects. Our panel will discuss recent developments in this area, the constitutional boundaries for state ROFR laws, and whether transmission ROFRs are warranted as a policy matter.
3:50 PM – 5:00 PM Panel 2: Mandates v. Market Incentives for Inverter-Based Resources
As more inverter-based resources interconnect to the Bulk-Power System, are regulators and electric market operators striking the right balance between issuing mandates and encouraging the evolution of markets to recognize all the generation attributes and services that each type of resource could offer? Our panel will discuss the latest developments in this area and whether more should be done to compensate inverter-based resources and other generation resources for their necessary attributes through market mechanisms.
