How does FERC determine whether there is “need” for new natural gas facilities? This will discuss FERC’s longstanding practices under the 1999 Certificate Policy Statement, court orders considering the issue, and recent certificate orders in light of the Commission’s revisitation of its certificate policy in 2018 and 2022. The panel will also consider what the standard for need should be.
