Recent SCOTUS Cases and Energy Enforcement

July 30 @ 3:30 pm 5:00 pm EDT

Join the Compliance and Enforcement Steering Committee in Washington, DC or virtually for this timely energizer.

Recent SCOTUS Cases and Energy Enforcement: a panel of experts will discuss, demystify and debunk what the Loper Bright, Jarkesy, Corner Post and Axon decisions from the U.S Supreme Court mean for FERC’s and other energy regulators’ enforcement programs.  Lawyers from all over the country and in all sorts of practices are talking about this flurry of decisions, but THIS program will focus specifically on what they means (and equally importantly what they do NOT mean) for federal energy enforcement law.

A panel of experts, who have worked at FERC in enforcement, in energy enforcement in private practice, or both with real world experience with the relevant statutes, regs and court cases, will delve into the real meaning of these decisions and make well-informed predictions about how the agencies, the bar, the courts – and maybe even Congress – will react. **Please note there are no CLE credits for this event**

Speakers include:

  • The Honorable Norman C. Bay, Partner – Corporate & Financial Services, Willkie Farr & Gallagher LLP – fmr. FERC Chairman and Director of FERC’s Office of Enforcement
  • Charlotte Taylor, Partner, Jones Day – Federal Appellate Specialist and U.S. Supreme Court Practitioner
  • Anand Viswanathan, Special Counsel, Jenner & Block LLP – fmr. Attorney in FERC’s Office of Enforcement, Appellate Attorney in FERC Solicitor’s Office, and Chairman’s Legal Advisor
  • (moderator) David Applebaum, Partner, Baker Botts L.L.P. – fmr. Director of the FERC Office of Enforcement, Division of Investigations
