FELJ Author Talk - Can state CO2 reduction policies be implemented through FERC-regulated tariffs?
Ari Peskoe, Senior Fellow at Harvard Law School's Environmental Policy Initiative, will be discussing his article in the Spring edition of the Energy Law Journal -"Easing Jurisdictional Tensions By Integrating Public Policy In Wholesale Electricity Markets." Mr. Peskoe's article explores FERC's authority under the Federal Power Act to approve wholesale tariffs that facilitate market participants' achievement of their legal obligations under renewable energy and CO2 policies. His talk will examine threshold legal issues concerning the boundaries of state and federal law, focusing in particular on FERC's jurisdiction to authorize a zero emission initiative developed by stakeholders of ISO New England.
